Ryan decides he wants to own the Denver, Colorado Frito Lay franchise. He makes and inquiry to Frito Lay, and they are excited to have him apply. Kim, the Frito Lay executive in charge of the Denver area, tells Ryan he as a great chance of approval, but he must lease a space for the shipping. In reliance on Kim's request, but before signing any contract, Ryan leases the space. A few weeks later, Ryan and Kim discuss the potential franchise again, and Kim indicates to Ryan that "Listen, the franchise is yours, but you need to buy two trucks." Ryan does so, but still there is no contract between Ryan and Frito Lay. After a few weeks, Kim informs RYan that Frito Lay has decided to contract with another franchisor and Ryan will not get the Frito Lay franchise in Denver.

Ryan protests, but Kim points out, correctly, that Ryan does not have a contract with Frito Lay.
