Salesperson Sam is acting as a designated agent for the buyer in the purchase of a home which faces a major street. The buyer tells Sam that he has heard rumors that the street will be widened soon, increasing the traffic and noise. If that is to happen, the buyer does not want to purchase the home. Sam calls the city's Public Works Department, who tells him there are no plans to widen the street. Sam tells the buyer that he called the Public Works Department and what he was told. The buyer purchases the home and two months later, street widening activities begin. Can the buyer win a lawsuit against Sam?
