Scarlett and Sofia have expanded their business operation to sell grain for chickens. Not that exciting but they realise chickens have no taste! They agree and the terms of the contract with Demelza's Chicken Grains are:

Price $2,500.

5000 tonnes of chicken feed.

to be delivered in 250 x 20 kg bags.

to be delivered on 1 December 2020.

On 1 December at 4:55pm the delivery arrives. Scarlett scurries outside and discovers the delivery is 126 x 40kg bags. She is concerned for her customers having to carry a bag of chicken feed twice the size.

a)Advise Scarlett and Sofia whether they have a claim against Demelza's Chicken Grains for breach of contract.

b)Would your answer be different if the contract did not include the line "to be delivered in 250 x 20 kg bags", if so, why?
