Negotiations Scenario:

The Prenup Nick Fowler IV and Sally Slocum are madly in love and have a wedding planned for next year. However, there is the small matter of a prenuptial agreement to work out.

The Players: Nick Fowler IV: Nick is 20 years old and is the son of Nick Fowler III, the owner and founder of MacroSoft, the worlds biggest computing company. Nick has lived a privileged life and will inherit $20 billion when he turns 25. Despite his gigantic fortune, Nick isnt the sharpest tool in the shed and has spent much of his young adulthood partying in clubs from Tokyo to Miami. He did not graduate high school but obtained a GED when he was 19.

Sally Slocum: Sally is an 18-year-old heiress who considers herself an actress. She has appeared in 9 made-for-TV movies and one direct to DVD release. However, she still has hope that she will one day win an Oscar. Sallys father was the founder of the popular fast food chain Chicken Ranch. Sadly, his love of fried chicken has left him with a weak heart and he is in very fragile health he has already had four heart attacks.

He is a multi-billionaire and everyone expects Sally to inherit his entire fortune upon his death. At Issue:

- How will the couples money be divided while they are married?

- What responsibilities will each person have to the other in the case of financial difficulties during the marriage?

- What will happen to each partys money if there is a divorce?

- Are there provisions for fault in the case of a divorce?

- What happens if one of the parties cheats?

- What happens if the couple has children?

- Are there any other items that come to mind?

1 The Prenup: Confidential Information for Nick Fowler IV and his attorneys You really want to each keep your own money separate while you are married. Sally spends her money, you spend yours. You have some, um, habits, that youd rather her not find out about and keeping separate bank accounts seem like the best way to keep your secrets away from your new bride.

If Sally suddenly goes broke while you are married (but you really cant see how that will happen) you are willing to give her a small allowance, perhaps $5000 a week. However, you are unwilling to give her free reign over your bank account. If you and Sally would happen to get divorced, you do not want her to be able to touch any of your money. Further, you absolutely refuse to pay any sort of spousal support to her in the case of a divorce. If youre going to have to pay her forever, youd rather not get married at all. If Sally cheats on you, you want her to pay you. At least $3 million. Finally, if you and Sally should have children and get divorced, you are willing to pay whatever is required for the childrens well-being, as long as there are provisions in place that make sure Sally cant get the money that is set up for the children.
