Scooter purchased a ticket to ride on a train from Vancouver to Squamish in order to go skiing. After she had boarded the train, the porter asked if she wished to place her ski equipment into a storage unit on the train. Because she did not want to be burdened during her journey, she gave her equipment to the porter. She was given a "small baggage claims" ticket before handing over her equipment. When the train arrived in Squamish, Scooter tried to collect her ski equipment. She was told that during unloading, the equipment had fallen onto the train tracks and had been crushed under the wheels of a passing train. When she threatened to sue, the porter told Scooter that the front of the "small baggage claims" ticket which she received contained an exclusion of liability clause for lost or stolen goods. The clause was printed in big, red letters.
