As she was boarding the train, the porter asked if she wished to place her ski equipment into a storage unit on the train. She gave her equipment to the porter and was then given a "small baggage claims" ticket. Upon arriving in Squamish, Scooter tried to collect her ski equipment. She was told that during unloading, the equipment had fallen onto the train tracks and had been crushed under the wheels of a passing train. When she threatened to sue, the porter told Scooter that the front of the "small baggage claims" ticket which she received contained an exclusion of liability clause for lost or stolen goods.
