Senators Benes and Seinfeld have introduced a bill that would amend the Federal Arbitration Act to invalidate all arbitration clauses in consumer contracts. Senator Costanza is a newly elected Senator who managed to secure election without once fielding a question about alternative dispute resolution. He knows nothing about the issues and has asked you to prepare a list of issues for his consideration. He specifically wants a list of at least five intelligent questions that he should ask at the upcoming committee hearing on the bill. He wants the questions to show that he is smart and thoughtful; he is nave enough to want to genuinely educate himself on the issues before deciding on a policy position. Make a list of five questions for him to ask the witnesses, who include: two consumers who had negative experiences with arbitration (one with a cellular telephone contract and one with a computer purchase); the president of a leading arbitration provider; the general counsel of a financial services company; and the chair of a state bar's litigation section.
