Shan Bank Limited hired Tech Soft, an IT Company, for developing and running a mobile banking application. Tech Soft also provided similar application to Nishtar Bank which bank discontinued this application due to some operational bugs. This fact was never revealed to Shan Bank before entering into agreement. Shan Bank filed suit and took plea that Tech Soft was under an obligation to disclose such fact but failed to do so hence it rescind the agreement. Is Shan Bank's stance lawful?
