Shiva travelled by railway from Kanpur to Lucknow, after purchasing a ticket from the Railway

Authorities. When he tried to alight at Lucknow railway station in the darkness, the train started

without a whistle. He fell down and his legs were chopped off by the wheels of the train. Shiva filed

a suit against this. The Railway Authorities contended that the fault was of the Electricity

Distribution Company, who failed to supply the electricity at that time.

Decide, whether the contention of Railway Authorities is tenable ? Is it a deficiency in the service on

the part of the Railway Authorities, under the Consumer Protection Act, 2019.

Q2. The prospectus issued by a company contained a false statement that P a very well-known successful

businessman was on its Board of directors. Q acting upon this statement applied to the company for

its shares.

R who did not rely upon this statement but on the basis of other information about the company

given in the prospectus applied for its shares.

Q and R were allotted shares by the company. S was a subscriber to the Memorandum of Association

of the company. T bought the shares through the stock exchange later on. Each of them wants to

know whether they can seek remedies for mis-statement in the prospectus. Advise them.

Q3. Hybrid Retails Ltd. issued a notice for the meeting of its Board of directors scheduled for on 5th June

2019 at its corporate office. One of the directors intimated that he would be participating in the

meeting through video conferencing. The Secretary contended that the meeting cannot be

participated through video conferencing and that the concerned director cannot insist that the

company should provide video conferencing facilities for attending the board meeting.

Is the contention of the Secretary tenable as per the provisions of the Companies Act, 2013 ?
