Simon, a retiree, wished to sell his antique toy collection for $10,000. He placed an advertisement in the newspapers. His 25-year-old nephew, Aaron, saw the advertisement and immediately rang Simon to say that he would like to see the antique toy collection before deciding on whether or not to purchase it. Simon told him to come to his house that evening. After viewing the antique toy collection, Aaron asked Simon if he would consider selling him the collection for $8,000. Simon said that he would not sell the collection for anything less than $10,000. Aaron said he needed a day to consider Simon's price. Simon told him that if he agreed to buy the collection, he should send him a text message on his cell phone within the next two days. The next day, Aaron sent him an email saying that he will purchase the collection from Simon for $10,000. However, Simon seldom checks his email or even uses his laptop, and thus never sees Aaron's email. After the second day, when Simon received no text message from Aaron, Simon sold the antique toy collection to his neighbor for $10,000. When Aaron came by to Simon's house to collect and pay for the collection, he was surprised to hear that Simon had sold it off. Discuss the legal positions of Simon and Aaron under the Law of Contract.
