Simon and Erin's nightclub in Mooloolaba is very successful, but as time passes the pair begin to argue over who should run the business.
Eventually, after a year together, Erin storms out of the nightclub after a particularly violent argument with Simon. As she is leaving, she tells Simon that she will not be back.
Simon is very angry about Erin's behaviour. There are bills to pay and Erin took care of the finances. She is not answering her 'phone. Simon wants to sue Erin for breach of their partnership agreement, although there is nothing about it in writing.
Erin claims that she didn't think that their arrangement was intended to be binding. She argues that it was just a joint venture opportunity between friends. She wouldn't have gone ahead, she says, if she had known that wasn't the case.
Advise Simon.
