Since exam two, we have focused on understanding foundational insurance policies under the ISO framework.
This assignment challenges your understanding of these chapters through your case study and analysis. Utilize the coursework for this assignment from chapters 19-24. You will have two weeks to prepare and present a well-designed, thought-provoking case analysis.
This assignment will have the following specifics:
- A total of three pages
- Case Study A - one and a half pages

Case study A Auto policy
Ron has a standard auto policy with the following coverages.
Liability 100/300/100; comprehensive - $500 deductible, collision - $500 deductible, rental 50/1000, uninsured motorist 100/300 and underinsured motorist 100/300
Ron was involved in a multi-vehicle accident on I-5 in a comparable negligence state; 51% rule.
No one was injured however, some of the drivers are blaming Ron for contributing to the accident. Ron believes he has coverage under his policy for his car and is confused about how insurance works. Ron told the police and insurance company that he was driving down the highway while there was a heavy marine layer of fog on the highway.
He kept the proper distance and did not see the car ahead of him stop. Ron collided with the car ahead of him and then veered into the left lane after the accident colliding with a car that was stopped in this lane. The police and Ron noticed that the car in the left lane did not have any lights on at the time of the accident.
Provide a full analysis of the accident and your thoughts on Rons policy coverage and liability coverage for the other two vehicles involved. Include what coverages may apply to Ron under his auto policy to repair his car. Analyze the liability arguments for both other cars involved in the accident. Present two arguments one where Ron is liable and the other where Ron is not liable. In the analysis of coverage under Rons auto policy, use the CA driving laws to support your analysis and specify if the other drivers are entitled to any recovery as this is a comparable negligence state using the 51% rule.
Case study B HO3/ Homeowners policy
Zoila recently purchased her first home and is planning a housewarming party to celebrate. She invites 10 of her friends to the party, but three of her friends (Marcus, Lowe, and Mary) spread the word to five other people who also show up. On the day of the party, heavy rainstorms caused water to flood the sidewalk and wooden stairs of her house. As a result, Zoila has 15 people at her home instead of the planned 10. She has enough chairs for 10 people, but she has to use five older chairs with wobbly legs, two of which are known to collapse when people sit on them. Zoila has arranged for catering to deliver food to her house at 7 p.m. and she leaves the outside porch light on for them. Although Zoila hadn't planned to have alcohol at the party, her friends David and Rhee hired a bartender for two hours as a housewarming gift. Zoila allows the bartender to work the party so that she doesn't hurt her friends' feelings.
Your task is to provide a comprehensive analysis of the risks Zoila is exposed to as a result of her housewarming party. You need to present arguments on the four elements of negligence and determine if there is any assumption of risk or Dram shop law elements that apply. In your analysis, you should outline the category of people and the duty they are owed (trespasser, licensee, and invitee). Finally, present your original ideas on what Zoila can do to mitigate her risk in this situation, knowing that she could not have reasonably planned for it. Use California state and case laws to support your conclusion.
