Stella delivers pizzas to customers for Pamelas Pizza Emporium. Pamelas Pizza Emporium requires Stella to wear a uniform and provides Stella with an automobile for purposes of making deliveries. Stella is also told how much money to collect from each customer for the pizza. She is paid an hourly rate plus tips. Pamelas Pizza Emporium has a policy against allowing passengers to ride along on delivery runs. One night Stella was asked to deliver a pizza to a customer. Her boyfriend had stopped by the Pizza Emporium and Stella allowed him to ride along with her in making the delivery. Stella was busy talking while driving the automobile and as a result ran a red light and had a collision with another automobile. The driver of the other automobile suffered serious injuries and has now sued Pamelas Pizza Emporium for damages.
