Strict and Pitty are spouses and joint account holders at Bank Flexible. One day, Pitty was approached by a salesperson who offers face whitening products priced at RM3,000.00. Pitty was interested in buying the product but did not have enough money. Without Strict knowledge attending overseas meetings; she has issued a joint account with her signature and falsified her husband's signature. When Strict learned about this, he scolded his wife. With tears, Pitty explained to Strict that she used the money to help her best friend, Victim, for cancer treatment. Strict accepts the reason and forgives Pitty. Seven (7) months later, Strict has attended a business forum in Florida, USA. She had met a Victim who was enjoying a vacation with her family there. When Strict asks about the condition of Victim's health, he denies having any illness. Strict realized that he had been deceived by his wife. He has returned home in a state of anger and urges Pitty to pay all the money he has incurred, otherwise, he will lodge a police report. Strict out of the house, but he did not go to lodge a police report. Due to panic over her husband's intentions, Pitty fired herself and died instantly. Strict came home and was shocked to find his wile's body. Due to the anguish and disappointment of the loss of his wife, he has filed a claim against the Flexible Bank alleging that the bank has committed a breach of responsibility where they should not allow during his wife's withdrawal as he has deceived his signature. Meanwhile, Strict's employer, Alamak Company (AC) had issued a cheque to Strict. The cheque was a payment for RM1,000 to Strict who was awarded the Best Annual Worker 2014. The cheque was handed to Strict, however, AC forgot to insert a date on the cheque. Strict presented the cheque to be credited to his personal account at OMG Bank. Upon receiving the cheque, OMG refused to accept it as it was not dated but Strict immediately inserted the date, which was one day earlier. However, OMG still refused to credit the cheque into Strict's account on the ground that the cheque was not valid without a date. In another occasion, Strict ordered certain goods from Black. Upon delivering the goods to Strict, Black issued a bill of exchange demanding Strict to pay on demand. The bill drawn by Black contained the following statement: "Pay if satisfied with the goods delivered and we hereby authorized you to pay on our account as per our previous transaction."
