1. The European Working Time Directive (2003/88) provides that the average working time for each seven-day period must not exceed 48 hours, including overtime except for the armed forces, emergency services or police or when 24-hour services are required. Moreover, employees have the right to at least 4 weeks of paid annual leave. Simon, an Austrian national, is living in Germany where he is working as a private security agent and often works long night shifts. After adding up his working hours, he realized that he works on average 60 hours a week. His flatmate, Emmanuel, a French national, is working for a state-owned company where he is only granted 15 days of paid annual leave. Every time he asked for more, his requests are denied.
