PRACTICAL APPLICATION 13.2 Leroy has his own business doing small repairs for homeowners in a tourist town. Most of his business comes from referrals by homeowners who count on him to do repairs to vacation properties that are rented out much of the year. He is working on the air conditioner for a homeowner when the tenant occupant of the house next door comes over and reports that they too are having a/c problems. Leroy has done quite a bit of work on that particular house over the years. He has always charged the same rate for labor plus parts. He calls the homeowner, who lives in another state, and leaves a message. He says if he doesn't hear back by the end of the day, he will assume that he should make the repairs, as it is very hot and the rental occupants have no air conditioning. Leroy does not receive a call and spends the entire follow- ing day repairing the air conditioner. He sends a bill to the homeowner for his labor and the cost of the parts. The homeowner refuses to pay on the basis that she never agreed to the terms.
