Suds Company operates a brewery and produces specialty beers at the request of various beer marketing companies. In a phone conversation, Suds orally contracts with Budweiser to produce for them, at a price of $1000, a batch of 1000 gallons of lima bean-flavored beer, for Budweiser to sell into a test market. This specialty product has never previously been made or sold in the US -- by Suds or Budweiser or anyone else. Beers flavored with other vegetables (tomatoes, cucumbers and carrots) have been sold in the US, however, and other companies have considered marketing lima bean beer. Suds buys the lima bean ingredient needed to produce the beer. After it has produced 400 gallons of lima bean beer, Suds receives a call from Budweiser cancelling the order. Suds insists that Budweiser is contractually obligated by the oral contract. Discuss the arguments that Budweiser would make as to why the contract should not be enforced, and the arguments that Suds would make for its enforcement.
