Susan: "I am going away for a skiing trip from December 10 through December 20. The light over my stove is broken. Could you fix it while I'm gone?

John: "Certainly, just put your keys under your door mat, I will let myself in. The cost for the repair will be about $ 80.--."

Susan: "That's fine!"

John: "We have a special offer now on burglar alarm systems. I could install a system for a total price of $ 360.--. Are you interested?"

Susan: "Let me think about it, I'll let you know."

Later that afternoon the following telephone conversation takes place between Susan and Jane, her maid:

Susan: "Hi Jane, as you know I will be going away on vacation, will you clean my house while I'm gone?"

Jane: "Of course I will. However, you are a bit behind in your payments."

Susan: "That's correct, I figure that together with the next cleaning, I will owe you $ 340.--."

Jane: "No, that's not correct, according to my records that will be $ 360.--."

Susan: "Okay, let's make it $ 360.--. The key will be under my door mat, as always!"

Susan totally forgets about her conversation with John concerning the burglar alarm system. Before she goes on vacation, she leaves $ 360.-- on her kitchen table (intended for Jane) with a note "This is the amount we agreed on! Please go ahead with the work as dicussed" Susan then leaves on vacation.

During Susan's vacation John comes to Susan's house a few days before Jane comes to clean. He lets himself in and fixes the light over the stove. He then finds the amount of $ 360.-- on Susan's kitchen table with the note "This is the amount we agreed on!". He believes that this is the money for the burglar alarm system, which he installs. Finally John thinks to himself:

"I bet Susan would like some nice electrical Christmas displays on her roof!"

He installs a huge Christmas display on her roof including a Santa Clause with twelve reindeer and many large flashing lights. Then he leaves.

When Susan returns from her vacation, she is shocked about the Christmas display, which she thinks is horrible. She then opens the door and sets off the burglar alarm, which drives her crazy. In her mailbox she finds an invoice from John as follows:

Repair of light over stove............................................ $80.--

Electrical Christmas decorations................................... $ 1,500.--"

Susan refuses to pay John anything. John sues Susan $ 1,580. Susan counterclaims and demands the return of $ 360 for the burglar alarm and demands the removal of the burglar alarm and of the Christmas decorations. Who will win and why?
