Recently a waiter in his restaurant negligently spilled a bowl of piping hot fish chowder onto the lap of one customer, Salma; causing second degree burns to her thigh and legs. Salma decides to sue, and Omar is surprised to know that Salma has named him as a defendant in her action. Omar is wondering why he should be liable because obviously it was the waiter who was at fault. Explain to Omar the legal justification why he, as the employer is considered liable and discuss what Salma need to prove to successfully sue him under the law of tort. (10 Marks)
