Tabitha Mulroney was a police woman with a city in the Province of British Columbia. She had been working for three years and a had a good performance record when police academy of the province established new fitness tests for her job. Mulrooney passed three of the four tests adopted by the province police academy. However, she failed to meet the final requirement to carry a 40 pound load one kilometer in less than 10 minutes. Her best time was 12 minutes and she was dismissed. She has sought relief through her union and the matter is going to arbitration. Her argument is that because of physiological differences between men and women the test was unfair.
