The attorney-client privilege is a rule of evidence protecting communications between attorney and client. PRIVILEGE APPLIES when testimony or evidence is sought under government compulsion; whereas CONFIDENTIALITY APPLIES in any circumstance in which an attorney may reveal or use information about a client or a client's case. THE SCOPE OF PRIVILEGE covers only confidential communications between attorney and client for the purposes of obtaining legal representation; whereas THE SCOPE OF CONFIDENTIALITY is very broad - covering any "information relating to representation" regardless of when, in what form, or from whom the information is acquired. Check those statements that are TRUE regarding the relationship between these two doctrines. The duty of confidentiality requires an attorney to take steps to protect the evidentiary privilege. Just because a communication that occurs as part of a representation is not privileged (either because it falls outside the privilege or because of an exception to privilege), doesn't necessarily mean that the attorney has no duty of confidentiality regarding that communication.
