The court decision must be one that is not included in the readings although it may be mentioned in decisions included in the course materials. In other words, you can review any family law case from any jurisdiction and court so long as it's a case we have NOT covered in the course. The analysis should include: the factual background of the case a description of the procedural posture of the case (who initiated the proceeding in the lower court, what was the party seeking, how did the lower court rule, which party is seeking review) the legal issue(s) before the appellate court the holding(s) of the appellate court the appellate court's reasoning a summary of any concurrence or dissent a critical assessment of the holding In the critical assessment, please explain whether you agree or disagree with the decision and why. If you disagree with the court's reasoning or use of precedent, be specific and explain how you think the court should have ruled. The goal of the assignment is to have you engage in legal research and evaluative thinking. The analysis should be approximately a letter in length
