The case of NY Times v Sullivan established the rule that in a defamation case:

 

a. An opinion can be the basis for a libel action

 

b. newspapers have a right to publish anything they want to whether true or not without any penalty because inquiring minds want to know use.

 

c. a public figure has to prove in a label action that either the newspaper knew the statement was false or acted with reckless disregard.

 

d. that defamation y a newspaper is the basis for a federal tort instead of a state tort.
