The case revolves around a dead fox and what to do with it. Lodowick Post was hunting on a vacant lot with his friends and with his dogs. He spotted a fox and began to pursue it. Jesse Pierson was walking by and saw the fox, killed it, and went on his way with the dead animal.

Post filed a lawsuit against Pierson claiming that the fox was his because he had begun pursuing it. Pierson countered that fox was his because he's the one who killed it.

The trial court ruled in favor of Post and the Pierson appealed the case and won the appeal.
