The case:

You are an employee of the Best Buy Vehicles Co., a car dealership where you work as a sales manager. The company is selling high end, expensive cars from the brands of Bentley and Lamborghini. Business is running well. Part of your work is to drive the luxurious cars around to new potential clients to try the vehicles and to attract the customers. These clients are not yet in contract with Best Buy Vehicles, they just go for a trial ride with you. On one rainy day, you are driving a Lamborghini with a client and the car suddenly slips on the wet road surface in the middle of an acceleration after a red light turned green.

As a consequence, the car hits a pol on the side of the road. The amount of the damage occurring to the sport car is around 50.000 EUR in value and furthermore your passenger client suffers injury and breaks one of his arms in the accident. You have no injuries. Your boss is the managing director of Best Buy Vehicles. Your salary is net 2500 EUR per month. The police reports that you did not exceed the speed limit at the time when the car lost the track on the road, and they also found an invisible oil spot where the car slipped as the primary reason for the accident. However, the report also states that you did not drive carefully enough (minor negligence) in the given weather circumstances. When you call your boss to tell him about the accident he answers that you are liable for all the damages and that he will make you pay for everything connected the accident. After a couple of months following the issue the injured client who was a professional architect reports that he lost his job due to the fact that he was unable to use his hand for drawing as he suffered permanent injury. The client claims damages on Best Buy Vehicles.
