The extent of federal government power has been an issue throughout most of US history. Competing interpretations of the 10th Amendment on one hand, and the "commerce clause" on the other, are at the heart of challenges to laws like the Affordable Care Act. The death penalty and the rights of prisoners have also been the subject of much debate over the past 50 years, at least.
