The following events occurred:

September 13

Ty Coon telephones Pete Moss--a celebrated landscape artist located in New York--and asks him to design and landscape the backyard for his new mansion in Mono, California. Ty Coon gives Pete Moss a budget of $85,000 and says the job must be completed by November 1. Ty Coon tells Pete Moss time is of the essence because he is throwing a grand open house for his friends at the new mansion.

Ty Coon provides Pete Mosswithphotos of his new mansion, along with a site plan for the entire lot. Since Pete Moss is so busy--and located across the country from Ty Coon--he says he will not have time to make a personal site visit to see Ty Coon's new mansion, but it will only take him a few days to come up with a lovely design.

September 19

2:00 p.m. Pete Moss e-mails Ty Coon the detailed drawings of his plans for the front yard. Ty Coon catches the mistake, and sends an e-mail back to Pete Moss informing him of the mistake.

2:30 p.m.Pete Mosscalls Ty Coon, and apologizes for the mistake, and says he will have the plans for the backyardcorrected in an hour, and will e-mail them over. Ty Coon tells Pete Moss how much he loves his work, and is very pleased with the designs. Right before he hangs up, Ty Coon informsPete Moss he needs to receive the revised plans no later than 3:30 p.m. because he is leaving for a month-long vacation to Antarctica, and will not have any Internet nor telephone access. Ty Coon ends by saying, "I just need you to make sure everything works out."

3:35 p.m. Pete Mosse-mails over the corrected plans for the back yard. Since Ty Coon has already left for his vacation, Pete Moss does not receive a reply from Ty Coon.

September 24

Knowing the tight time deadline Ty Coon has, Pete Moss hires Corey Ander, a local contractor, to begin work on the landscaping job at Ty Coon'smansion. Unfortunately, Pete Moss reverses two of the digits for the address of Ty Coon'smansion, and ends up giving Corey Anderthe address for Sheila Blige's mansion, which is located a block away from Ty Coon'smansion.

October 8

Corey Ander begins work on Pete Moss' landscape design at Sheila Blige's mansion. Sheila Blige happens to spending the late fall at her beach cottage, and is not home.

October 25

Corey Andercompletes the landscaping exactly according to the plans, and sends his invoice to Pete Moss. Pete Moss sends an e-mail to Ty Coon letting him know the landscaping job has been completed, and attaches his own invoice for $91,000.

October 26

Sheila Blige returns to her mansion, and notices her back yard has been completely re-landscaped. Initially, she is upset, but then she sees how lovely her back yard is, and she is now very pleased. Sheila Blige has no idea who did this.

October 27

Ty Coon returns home, and sees nothing has been done to his back yard. He immediately FaceTimes Pete Moss to show him no work has been done on his back yard.

After contacting Corey Ander, Pete Moss realizes all the landscaping work was done at Sheila Blige'smansion down the street.

November

Ty Coon is furious because his backyard has not been re-landscaped for his grand open house, and sues Pete Moss for breach of contract. Corey Andersues Pete Moss for payment on the landscaping work he did. Pete Moss sues Sheila Blige in an attempt to recover money for the work that was done on her back yard.
