The Gardners sued on behalf o their young child who was injured at Henderson Water Park. The Gardners sued both Henderson Water Park, LLC and seven members of the LLC as individuals. The Gardners alleged the members were negligent and contributed to the child's injuries because of inadequate lifeguard staffing. The LLC members claimed that they were not individually liable for the negligence and that the alter ego theory did not apply to LLCs.
