The landlord, Mr. Mujib Hendry, is the owner of a residential property in Toronto, ON at 123 Any Street, M1X 1X1. Where he rents out a unit to the tenant, Mr. Afaq Calero. The tenancy agreement between them began in March 2022 and is governed by the Residential Tenancies Act (RTA) of Ontario, Canada. However, the tenant has breached the terms of the agreement by failing to pay his rent on time and interfering with the rights of other tenants in the residential complex.
The tenant has repeatedly been late in paying his rent, sometimes by more than one month, in violation of section 20 of the RTA. The landlord has sent him several notices of termination for non-payment of rent (Form N4) as required by section 59 of the RTA, but the tenant has not paid the rent owing or vacated the unit. The landlord and the tenant have also agreed to end the tenancy by signing an agreement to end the tenancy (Form N11) as permitted by section 37 of the RTA, but the tenant has not moved out by the agreed date.
The landlord claims that the tenant has substantially interfered with the reasonable enjoyment, lawful rights, privileges or interests of the landlord or other tenants in the residential complex, in contravention of section 64 of the RTA. The landlord has given the tenant two notices of termination for interfering with others, damage or overcrowding (Form N5) as required by section 65 of the RTA, but the tenant has not stopped the interference or corrected the behaviour within seven days of receiving each notice. The landlord has two witnesses, Sara and Sam, who are other tenants in the residential complex, who can testify that the tenant has caused noise, disturbance, damage and safety issues that have affected their living conditions.
The landlord wants to evict the tenant as soon as possible and recover any rent arrears, damages and costs from him. He can apply to the Landlord and Tenant Board (LTB) to end the tenancy and evict the tenant by filing an application to end a tenancy and evict a tenant (Form L2) along with copies of the notices of termination (Form N4 and Form N5) and certificates of service to prove that he gave them to the tenant as required by section 69 of the RTA. He can also file an application for rent arrears and/or compensation for use of property after termination (Form L9) along with copies of any relevant documents such as rent receipts, invoices or estimates to support his claim for money owed by the tenant as allowed by section 87 of the RTA.
Afaq threw a party in the house on oct 1 without asking the landlord Mr.Mujib and the other tenants. Afaq got super drunk to the point where he started fighting the tenant Sam and Sexually harassed the tenant Sara. The two tenants have made several complaints to the landlord and even got police involved.
