PROBLEM QUESTION 1. Dan, a truck driver, was assigned to deliver fresh vegetables and flowers from Cameron Highlands to Singapore. On his way to Singapore, he encountered a bad weather and landslides in Bukit Tiuggi, Karak Highway. This had caused his journey to be delayed for two days. Dan tried to communicate with Din, the owner of the goods, but failed. Leaving Dan with no choice as the vegetables and flowers became to wither, Dan sold them at Bukit Tinggi market at a lower price. This had caused Din to suffer losses. Din wanted to take an action against Dan for the losses he suffered. Advise Dan and Din as to whether any form of agency has been established between them.
