The State of X enacted a law allowing state and county officials to confiscate property that they "reasonably believe" was purchased from funds connected to illegal drug sales. The Protect Our Rights Association was formed to protect the constitutional rights of citizens in State X. The Association has data showing that this law is used much more frequently in Black and Latino communities. Several Black and Latino members of the Association who reside in these communities had their property taken by county officials under the law. The Association sued state and county officials in charge of enforcing the law in federal court on behalf of its members, claiming that the law was unconstitutionally applied based on race and ethnicity. The Association requested injunctive relief ordering state and county officials to stop implementing the law in a discriminatory manner and for county officials to return members' property. It also sought monetary damages for the harm and emotional distress caused by taking members' property. Before filing the lawsuit, the Association held protests about the law and publicly threatened to sue.
