The witness Pauline Perjury has been called to stand in the Case of the State of Bliss vs. Mr. Killer. Ms. Perjury was interviewed by Officer Friendly 3 days after Victor had been shot in the parking lot of the Quickie Mart at 3 AM. Here are 10 things that the State wants Ms. Perjury to say while on the witness stand. Please discuss the admission of the following statements:

  1. I was at Freddie's house that night, standing outside in the front yard. I was talking to Freddie and Frank. We were all drinking beer and smoking weed. I lost track of just how many beers, but I don't think it was much more than 10 or 12 beers.
  2. I don't recall everything that was said, but Frank said to Freddie that Mr. Killer was gunning for Victor because Victor owed him money.
  3. When I talked to Officer Friendly a few days later, I told officer Friendly that I was Crunk, you know part drunk and part stoned that night. I don't really think I was that messed up, but I was not trying to be witness.
  4. While we were all talking, I heard some loud arguing down the way at the Quickie Mart. I looked down that way.
  5. It was kind of dark down at the Quickie Mart, but I am pretty sure that I saw Mr. Killer had a gun in his hand and it looked like he shot Victor. At least fire came out of the end of the barrel and I saw Victor fall down.
  6. Somebody yelled, "Mr. Killer just shot Victor." I don't know who said it, but they sure sounded excited.
  7. Freddie was standing right next to me, he said, "I just saw Mr. Killer shoot Victor."
  8. Frank said, "I am way too drunk to see anything, I don't want to be a witness."
  9. The next day I spoke to Frank. He told me that he has actually seen Mr. Killer shoot Victor, but he wasn't looking to be a witness.
  10. Later that same day I heard that Mr. Killer had been arrested. I needed some weed and Mr. Killer was my regular supply. I figured his mom might be able to help me out, so I went to her house. Mr. Killer's mom said that "even though Mr. Killer had shot and killed Victor, she didn't think that there was enough evidence to convict him, or at least that is what Freddie told her."

Please focus on the Hearsay rules. Is the statement hearsay, does either an exclusion or an exception apply?

Ms. Perjury is the first witness to testify. The state also intends to call Freddie, Frank and Mr. Killer's mom later in the trial. None of these witnesses are expected to be cooperative with the State.
