A contract can be discharged by a breach of obligations. "Contractual obligations can cease to exist through a breach of contract," "The general definition of a breach of contract is where there is a failure or refusal by one or both of the parties to perform one or all of the obligations imposed upon them under the contract. A breach of contract may also occur where one of the terms has been performed, but it has not been performed to the appropriate standard imposed by the contract" (Teacher, Law).

A repudiatory breach is a type of breach of contract. "A repudiatory breach can be defined as a breach of contract which deprives the other party of a substantial benefit under the contract" (Teacher, law).

Abbots failed to deliver the wine on or before April 3^rd. The delivery of wine on or before April 3^rd was a covenant of the contract. Breanna requested the wine be delivered by April 3^rd to prepare for a wedding shortly after the delivery date. Breanna had to buy wine from another vendor for the wedding.

A repudiatory breach deprives a party of substantial benefit outlined in the contract. The delivery of wine by April 3^rd was clearly outlined in the contract. Due to the lack of delivery by April 3^rd Breanna had to find a new wine vendor. The substantial benefit provided by Abotts was the delivery of wine by April 3^rd. Since they did not provide this substantial benefit Breanna was deprived of said substantial benefit. Therefore, the contract could be discharged due to a breach of contract.
