They also provided and received assistance from consultants Jamie Ruppmann and Gail Mayfield. They ensured Mark's curriculum was adapted to his abilities and his needs. Later, Fran Johnson joined the IEP team and aided in managing Mark's behaviors in the classroom. Mark demonstrated disruptive behaviors daily in the classroom setting and it was stated that it was noted that when viewed it took over 8 minutes for the teacher and aide to settle him down. At the end of the year his IEP team deemed that no academic progress was being made and proposed to place him in a class specific for autistic children at Leesburg Elementary. Mark's parents refused to approve the IEP and used the claim that it failed to comply with IDEA. This initiated due process hearing in the county where it was found his behavior was disruptive and no academic benefit was coming from being in a regular education classroom. The state reviewed this finding on May 3, 1995, and affirmed the decision. The Harmanns then challenged this in the federal court. The family withdrew Mark and moved him to another county.
