This initiated due process hearing in the county where it was found his behavior was disruptive and no academic benefit was coming from being in a regular education classroom. The state reviewed this finding on May 3, 1995, and affirmed the decision. The Harmanns then challenged this in the federal court. The family withdrew Mark and moved him to another county. The court of appeals disagreed with Mark's family and overturned the decision from the previous court.
