You are to select one case, read it. The purpose of a case brief is to assist you in better understanding the case, part by part, and to provide a summary for future reference.

All case law contains essentially the same parts:

  1. Case Citation
  2. Facts
  3. Procedural History
  4. Issues
  5. Holding
  6. Rules of Law
  7. Analysis
  8. Conclusion

Case briefs can be written in slightly different formats, but this is the format you will use for purposes of this assignment.

Plessy v. Ferguson, 163 US 537 (1896)

Loving v. Virginia, 388 U.S. 1 (1967)

Bush v. Gore, 531 U.S. 98 (2000)

  1. To prepare a case brief, you must first perform a "close reading of the case." Make a copy of the case you will brief. This is your working copy for you to "annotate." Annotating is a tool used for close reading. Here are some common annotations (but you are free to do whatever works for you):
  2. Procedural History=PH
  3. Facts=F
  4. Issues=I
  5. Holding= H (I usually star or highlight the holding in a case.)
  6. Rules of Law=RL
  7. Analysis=A
  8. Conclusion=C
  9. The more you practice, these terms will become second nature to you. Don't give up! This takes practice.
  10. Select one of the three cases presented above and brief the case that you selected.
  11. Use the format listed in this assignment and covered in the "How to Write a Case Brief" PowerPoint presented in this week's content.
  12. Correct grammar, sentence structure, and spelling should be used.
  13. The brief should use theBlue Book style for legal citations.
