You will be required to report on the relevant tribunal's statutory framework as well as your observations during the hearing. The assignment is due by October 18, 2024. Please submit assignments via Brightspace. No extensions will be granted for failure to make timely arrangements to complete this assignment. This assignment rests entirely on student initiative. You will be required to (1) inquire into when the Court is hearing judicial reviews and (2) make all necessary arrangements to attend the hearing. That being said, feel free to confirm with me whether your chosen course of action is appropriate if you have any concerns. I strongly recommend that you look into this and make necessary arrangements early on in the semester as hearing dates may be limited. REPORT (40% of Final Grade) It is your responsibility to ensure that your report addresses all relevant questions for your chosen hearing. Format: Times New Roman 12/Arial 11 - Double-spaced - 12 page limit. Citation: McGill Guide (9th) Edition. Federal Court Judicial Review Hearing Background (7.5%) Who are the parties? Who is the judge? What are the facts of the case? Provide a brief summary of the administrative decision-maker's decision. What are the issues at play? Statutory Framework (7.5%) Provide a description of the administrative decision-maker's statutory mandate and purpose generally. What are its powers? Who are the decision-makers? How are they appointed? What was the statutory basis for the decision under review? Be as specific as possible in identifying the relevant statute and provision. Standard of Review (5%) What are the parties' positions on standard of review? If standard of review is conceded, what are the positions of the parties on how that standard of review should be applied? (i.e. very deferential/less deferential) Discuss your views on the parties' submissions on standard of review in light of the principles discussed in class. Merits of the Case (10%) On what grounds is the Applicant seeking judicial review? Summarize the arguments of each party with respect to each of these grounds. Based on the principles discussed in class, which arguments did you find most convincing and why? Analysis (5%) Discuss one aspect of the hearing that you found most interesting (may relate to any aspect of administrative law). Why was this of particular interest to you? What issues does it raise in light of the principles discussed in class? Writing Quality/Effective Communication/Clarity (5%) NOTE: Those students who wish to consult the parties' written submissions may contact the Court's Registry to obtain a copy. HOW TO ATTEND A HEARING? Federal Court The Federal Court posts a calendar of its hearings here: HYPERLINK "https://www.fct-cf.gc.ca/en/court-files-and-decisions/hearing-lists" Federal Court - Hearing Lists (fct-cf.gc.ca). If you click on "Advanced Search" and select "Judicial Review" under "Hearing Type", this should provide you with a list of relevant hearings you can tune into across Canada. The Court indicates that where the matter proceeds remotely, which will be the case in most cases at this time, arrangements may be made to allow for attendance of members of the public provided that an advance notice of two business days is given. Such notice must be given by selecting the icon "Register for a hearing" and providing your name and email. Should you have questions about a particular matter or wish to consult the parties' written submissions, you may contact the Federal Court's Registry. Ensure that you know the court number for the matter you are interested in. The Court Registry may be able to provide you with an electronic copy of the parties written submissions or other relevant information. Please be courteous with Registry staff and advise them that you are a student learning about administrative law. Note: Students may also attend the hearing of a judicial review at the Ontario Divisional Court. No information is available on public attendance online at this time. If students wish to pursue this option, they will have to contact the Court directly to obtain a calendar of relevant judicial review hearings, and arrange attendance.
