War and Foreign Affairs?

Has the Executive Branch taken on an inordinate amount of power in regards to the making of foreign policy and the waging of war?Why? Why not?

Should the Supreme Court be responsible for definitively defining these executive powers, or are they clearly described in the Constitution?

Some critics argue that the legislative branch has abrogated its own power in these two areas. Do you agree with this contention? Why? Why not?

Does the Supreme Court have an obligation to address this issue and attempt to craft a long-term resolution?
