WEIR VACUUM A man buys a central vacuum system from Weir Vacuum for $800.00. A standard contract is signed and includes installation. The system is purchased on Boxing Day 1998. Installation is to take place in two weeks. He leaves a $200 (cash) deposit. The company calls to deliver and install the unit and arrangements are made over the phone for installation on January 15, 1999. During a test of the installed unit the system fails. The customer tells the Weir Vacuum representative that he is no longer interested in the unit because it failed and demands his money back. The service representative leaves behind the unit and tells the customer he will report back after talking to his manager. After the service representative leaves, the customer dismantles the unit himself and puts it outside the front door of his house. He phones Weir Vacuum and tells the manager to pick up the unit from outside his house immediately and to bring with him the $200 deposit. During the night the unit is stolen. Weir Vacuum sues the customer for $600 and the customers counter sues for his $200 deposit. Questions the mailment
