Three weeks ago, Baljit, a dealer in tents and camping equipment, placed an order for 1,000 high strength aluminium tent pegs from Pegco Ltd paying a deposit of 500. The pegs were to be delivered within 7 days. The pegs never arrived and Pegco Ltd has now gone into liquidation. There are exactly 1,000 high strength aluminium tent pegs currently stored in Pegco Ltd's warehouse but the liquidator is refusing to supply them to Baljit. Baljt has now found another supplier for these type of tent pegs but the price is significantly higher than that agreed with Pegco Ltd. On Monday, Baljit agreed to purchase a large frame tent which Sewit Ltd, a tent manufacturer, had on display. As part of the deal the sales representative agreed with Baljit to have the tent fully dismantled and packed into its carry bag and to replace two of the poles which were damaged, all prior to delivery to Baljit. Payment was to be made on delivery. The tent was duly packed away and the poles replaced the next day. However, prior to delivery, a small fire at Sewit Ltd's premises resulted in some damage to the tent. On Wednesday, Baljit telephoned Tracy, another dealer in camping equipment, and ordered 20 'Brightflame Deluxe' camping stoves. Tracy had 35 of such stoves stored inher warehouse and it was agreed that the 20 stoves ordered would be supplied from such stock. It was agreed that the goods would be despatched on Monday of the following week with payment to be made within 10 days of despatch. Immediately after the telephone call, Tracy went into the warehouse and set 20 stoves to one side with a notice on them stating "Sold to Baljit". Unfortunately, before any stoves were despatched to Baljit, thieves broke into Tracy's warehouse and stole the 20 stoves labelled for Baljit. Tracy has other customers who are willing to pay a higher price than that agreed with Baljit for the remaining stoves. On Friday, Baljit visited the premises of Ufix Ltd, a wholesale supplier of camping equipment. The manager of Ufix Ltd showed Baljit a container holding 500 sleeping bags and Baljit agreed to purchase 200 of them with payment to be made within 10 days of despatch. The next day, all 500 of the sleeping bags were loaded on board a lorry owned by Speedit Ltd. The driver was given instructions to first supply 300 sleeping bags to Fred, another customer, and then supply the remaining 200 sleeping bags to Baljit. Baljit was informed by telephone that the goods had been despatched. However, when the sleeping bags arrived, Baljit found that they had been ruined by rain water which had penetrated the rear of the delivery lorry. Advise Baljit.
