Scenario: Biemer Transport Pty Ltd has recently ventured into transportation of highly flammable liquids. They have employed Ramesh as a delivery driver. Ramesh is an experienced driver and has previously worked for a competitor. In December last year Biemer Transport instructed Ramesh to deliver a consignment of petroleum products to a service station in Frankston on the outer parts of Melbourne. Rameshwas tired after making several deliveries but opted to go ahead with the delivery. On his way to Frankston, Ramesh was distracted by a call on his cellphone which he decided to answer. As he was speaking on the phone, he lost control of his truck which collided with an oncoming vehicle that belonged to George. George's car is completely written off and he does not have any insurance over. George has miraculously survived the collision with little injury. He has only recently taken delivery of this car from the new car dealership upon payment of $45,000. Biemer Transport Pty Ltd have refused to take any responsibility for the crash. They say that Ramesh should not have driven if he was tired.
