The owner of Angel Pets Boarding Kennel testified at trial that on June 15, 2009, he personally inspected the fence.He was unable to see a hole or gap but he did find a loose board.However, he further testified that the nails holding the board in place were still in place.Other employees of the kennel testified that they visually inspected the fence everyday but admitted they did not inspect each individual board in the fence.In addition, over the kennel's 10 year operation, only 2 dogs out of the thousands they have cared for ever escaped.Angel Pets Boarding Kennel acknowledged that it was possible their gardener, Green Lawns Service, could have loosened the board when it mowed the lawn with its ride on mower.In fact, this had occurred several times in the past but each time, Angel Pets Boarding Kennel relied on the gardener to inform them of this so they could fix the fence.They did not inspect the fence each time after the gardener mowed the lawn.
