Destafano the court was tasked with determining if the city of New Haven intentionally discriminated against a group of white firefighters by throwing out the examination results that were supposed to help select the firefighters who would receive a promotion. This exam was created and administered by Industrial/ Organization Solutions Inc. who analyzed the lieutenant and captain positions to create an exam that would test the applicant's knowledge, skills and abilities needed to perform the jobs. (Mitchell, C. E. 2013) The results of the exam disqualified a majority of the Black and Hispanic applicants from the promotion leading the city of New Haven to make the decision to disregard the test results entirely. This decision was made to get ahead of any discrimination complaints brought against the city by Black and Hispanic applicants, in doing this without determining the validity of the exam it brought the decision from the Supreme Court that the city was guilty of illegal disparate-treatment and discrimination by not promoting those who scored the highest on the exam
