Tola is a small business owner in Austria. She makes childrens toys which are sold online across the EU. She uses a delivery company, DirectToYou, which has drivers in EU countries.

In the UK, her business relies especially on trade around Christmas - 50% of her annual takings come from international sales in the 2 weeks before Christmas.

In order to highlight environmental degradation, Generation P, a not-for-profit organisation, calls for a large protest the weekend before Christmas 2019. The aim of the protest is to block road travel on main roads around the EU to raise the issue of climate change. Authorities are not notified of the protest in advance. The protest is highly successful - streets are blocked for numerous days and all traffic is prevented from driving through major thoroughfares.

Tola is incensed at the inaction of the authorities. She tells her lawyer about her problem. Her lawyer suggests Tola bring a case against the UK government.

Explain how this case could come before the CJEU.

Could someone please explain to me how a case could be brought based on human rights?
