TORT LAW ASSIGNMENT

A. Mrs Kamau's husband went to a casuality department of the Dipalata teaching hospital complaining that he had been vomoting. The doctor refused to examine him and he was told to go home and consult his own doctor in the morning. Mrs kamau's husband was infact suffering from arsenial poisoning and he died four hours later. Mrs kamau suded DTH alleging that they had been negligent in treatment given to her husband and as a result of their negligence her husband had died. What her the prospects of Mrs kamau not succeeding in her action with regards to causation and remoteness of damage?

B. Mr Chipango's assignment was invaded by mr Chanda for two minutes and that did not sit well with Mr Chipango. When mr chanda was asked as to why he strayed into Mr Chipango's apartment his defence was that he lost way to his home. With the aid of decided cases, explain at least five (5) modes such a tort highlighted coupled with defences.
