Tort Law-

Thankfully, I have not had any circumstances in my personal life that have involved or exposed me to this law. However, I have heard of multiple cases in which the Tort Law would apply, as well as incidents that would apply while on duty. While completing the reading for this week, I examined the three different types of torts which are intentional, negligence, and strict liability.

Intentional torts are harms that have been caused by the willful misconduct of another, such as assault, fraud, and theft (Hayes, 2022). However, intentional torts can also include battery, false imprisonment, assault, etc. These examples are also considered crimes in which criminal cases can be developed. One type of case that I encountered multiple times a week while on patrol was battery. I was dispatched to locations where the parties resorted to physical violence instead of using verbal communication to resolve the conflict. Some of these instances rose to the level of a state charge, while others resulted in a battery citation. It depended on what transpired during the incident and the type of injuries suffered (if any).

Negligent torts are harms done to people through the failure of another to exercise a certain level of care, usually defined as a reasonable standard of care (Hayes, 2022). One example of an incident that correlates to negligent tort law that I've encountered while on duty is a car accident. I was dispatched to an accident caused by a driver's disregard of a red light. This accident did cause damage to the other driver's vehicle, as well as minor injuries. I completed the accident report for the incident, the injured party also planned to file a lawsuit against the driver of the striking vehicle. I have also been dispatched to a case in which the dealership sold the buyer a defective vehicle. Strict liability tort law can be useful in that type of incident.
