Trains 'r Us ("Trains") operates non-stop train trips from Boston to New York to Washington 24 times a day.The standard procedure is to have the train start moving on the hour, every hour. There are signs to this effect all over every station. Barbara, a passenger on one of these trips, gets injured when she is halfway on the train when it starts moving. Her shirt gets caught in the train door and she is dragged along the floor for several feet until the train is stopped. She sues Trains for negligence. At trial, Trains seeks to introduce evidence to the effect that all railroad companies have the same practice as they do in the procedure at issue in this case.
