Undue influence arises from a special relationship, such as a fiduciary relationship, in which one party's free will have been overcome by undue influence of another. An example would be an elderly person and their caretaker whereby the elderly person sells his home for next to nothing to caretaker because he or she is induced in to selling the home under pressure by the caretaker.
