Two years ago, I was building an addition to my home, and I was informed by a county building inspector that there had been a recent change in the county ordinance that required plastic to cover all of the insulation in the walls in newly built homes. I spoke with the inspector about the reason for this new change in the ordinance, and he explained that the plastic would reduce air blowing into a home, thus make the home more energy efficient. Because of the reason for the plastic, I spoke with him about one of the walls in the home, since it was completely underground and no air could blow through that wall. He said it didn't make any difference, that the ordinance (law) required it. If I didn't comply with the law, I could be fined, put in jail, and my home could be condemned. I also discussed with the inspector that I had taken out my permit to build the addition to my home before the ordinance (law) change, and he informed me that I still had to comply with this retroactive application of the ordinance (law). What would be my argument in a hearing to try to convince the judge or administrative hearing officer that I should not have to comply with the changes in this ordinance? Provide the best answer?
