Under a SIJS immigrant relief, you must have a special juvenile court order finding that she/he cannot be reunited w/ one or both parents b/c of abuse, neglect, abandonment OR a similar basis in law.

Question: If only one parent is the abusive/neglectful one though, why would the court have to step in because couldn't the child just live with the non abusive/neglectful parent? Please explain and cite with support.
