University College, a public institution, hired a new VP of Student Affairs to enhance the safety on the campus.As part of a new college policy that was created based on the Drug Safety in Education Act recently passed by Congress, all student athletes were to be drug tested.The policy was accepted by the President and passed by the Board of Trustees.Johnny Martel, a journalism major and free-spirited quarterback on the football team, who is aspiring to play in the NFL, decided to write an article for the school paper opposing the drug testing of athletes and advocating for legalizing certain drugs.The President did not permit the school paper to print the article.Then, when it came time for Johnny to be drug tested, he refused to sign any forms requiring him to be drug tested and further refused to be drug tested.He was immediately dismissed from the team and his scholarship was revoked.Johnny then sued University College saying that both the new policy and the Federal Act violated his rights.
